5.1 International Transfers
It is important to note that some of our suppliers may be based in the United States, be affiliated with an office in the United States or process data in the United States. For this reason, the information we collect from you may be processed in the United States. Following the judgment in case C-311/18 (Schrems II case), the EU "adequacy" judgment was overturned under Article 41 of the GDPR, meaning that your data may not receive equivalent protection in that country to that which it enjoys under the European General Data Protection Regulation.
In this regard, the UKIO is monitoring the transparency documentation published by the above companies and is assessing the complementary mechanisms proposed by them. Further information will be provided as it is made available by the companies and the relevant supervisory authorities. In the meantime, for the use of these services, we rely on the exceptions for specific situations provided for in Article 49 of the GDPR. In particular, to collect and transfer personal data to the United States we will use: your consent (art. 49.1.a) or the performance of a contract (49.1.b). We and our agents strive to implement appropriate safeguards to protect the privacy and security of your personal data and to use it only in ways that are consistent with your relationship with us and with the practices described in this Privacy Policy.
United States
Specifically, the information we collect from you may be processed in the United States. The United States has not yet received an "adequacy" finding from the European Union under Article 41 of the GDPR, which means that your data may not receive the same protection under the GDPR.
Pending further developments in this area, we rely on the exceptions for specific situations set out in Article 49 of the GDPR. In particular, we collect and transfer to the US personal data only with (i) your consent and/or to (ii) perform a contract with you. We and our suppliers apply appropriate safeguards to protect the privacy and security of your personal data and to use it only in accordance with your relationship with us and the practices described in this Privacy Policy.
Please note that transfers to the US are limited and, in particular, transfers from large cloud companies (Google, Youtube, etc.) could be declared illegal by the courts. Therefore, this paragraph should not be understood as a disclaimer that may protect the company in case of inspection, but rather as a gesture of good faith or transparency that allows users to make a better decision.
